15.2 At Costway’s sole discretion, we may require you to submit any disputes arising from your access to or use of the Website or the Website’s contents, or from the Terms, including disputes arising from or concerning their interpretation, violation, invalidity, non-performance, or termination, to final and binding arbitration under the Rules of Arbitration of the American Arbitration Association applying California state law.

You agree to indemnify, defend, and hold harmless Costway and its parents, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorney’s fees, made by any third-party due to or arising out of your access to or use of the Website or its contents or breach of these Terms, including, but not limited to,your failure to provide accurate, complete and/or current information when accessing or using the Website, your misuse of this Website, your user comments, or your violation of any law or the rights of a third party.

18.1 The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.

18.2 These Terms are effective unless and until they are terminated by either you or Costway. If you wish to terminate these Terms, you may do so at any time by notifying Costway that you no longer wish to access or use the Website. You may also terminate at any time by ceasing use of the Website.

18.3 Any breach or violation of these Terms will result in a termination of your access to or use of the Website. If, in our sole discretion, you fail or we suspect you have failed to comply with any Term, we may terminate your use or access at any time without notice. If such termination occurs, you will remain liable for all amounts due up to and including the date of termination.

19.1 If any Term is held to be invalid or unenforceable, such Term shall be severed from the Terms and Conditions and shall not affect the validity or enforceability of the remaining Terms.

These Terms, in conjunction with any other policies posted By Costway.com, Inc (Costway.com). on the Website, constitute the entire agreement between you and Costway and govern your access to and use of the Website. These Terms supersede any prior or contemporaneous agreements or any other communications, oral or written, between you and Costway.

In the event Costway deliver outside our time commitment on applicable services, we will on request refund or credit you with the shipping charges (or the proportionate part of those where only some of the packages in a shipment fail to meet the applicable time limit), provided that the following conditions are fulfilled:

a) Shipping destination must have been correctly valid and completed.

b) You must have notified your request for claim to Costway in writing to [email protected] within 15 days from the date of scheduled delivery and advised us of the receiver's name and address, date of shipment and the UPS tracking number.

c) Any orders going through the weekend day(Saturday and Sunday)is not available to meet the applicable money-back guarantee since UPS also take day off.

d) Any orders placed after 3pm are not guaranteed for UPS 2nd Day Air and UPS Next Day Air delivery.

The guarantee does not apply when late delivery results from the package not complying with the service restrictions and conditions set out in our Terms and Conditions and Shipping Guide, from events beyond our control (force majeure) or due to any suspension of carriage or the exercise of any lien in accordance with our Terms and Conditions and Shipping Guide.

1. Costway offers professional AC installation services for $299, ensuring fast, convenient, and safe enjoyment of your items. (Currently available for addresses within a 50km radius of Ontario, CA 91761). Please confirm your address falls within the service area when placing your order.

2. Once you've selected our installation service, expect a call from one of our professionals within 24 hours after delivery to confirm the installation time.

Please be aware that we are responsible for connecting you with professionals only; the installation fee must be paid directly to the installer. After verifying that everything is correct, please pay for services rendered. Please note that installation fees are non-refundable.

3. You have the right to request service cancellation before the installation personnel arrive.

4. After the installation is complete, please test the product on the spot. If there are any issues, please communicate directly with the installation personnel. Once the installation personnel have left the premises, it is considered that the installation is completed, and the installation fee is non-refundable.
